1. Scope of Application

These General Terms and Conditions (GTC) apply to all online reservations, bookings, payments and voucher purchases made via the website and the reservation system of NETT & NiEDLiCH GmbH.

Deviating terms and conditions of customers shall not apply unless their validity has been expressly agreed to in writing.

3. Subject Matter of the Contract

The subject of the contract is the time-limited reservation of a visit to our parent-and-child café.

The reservation includes a time slot of 3 hours, within which one or more tables are reserved exclusively for the specified number of guests. The amount of the reservation fee depends on the number and age groups of the guests.

In addition, optional services such as packages (e.g. birthday packages) or vouchers may be booked via the reservation system. Booking of extras is generally possible, but is currently not actively offered.


4. Conclusion of Contract

The presentation of reservation options on the website does not constitute a binding offer.

A binding contract is concluded only when:

  • the booking process has been completed in full and
  • payment has been successfully made or
  • the reservation has been expressly confirmed by us.

In the case of advance payment, the contract is concluded at the latest upon receipt of payment.


5. Prices and Payment Methods

All prices stated include the statutory value-added tax.

The following payment methods are available:

  • PayPal
  • Advance payment by bank transfer
  • Payment by voucher

Payment on site is only possible in exceptional cases or in the event of technical problems and does not constitute an entitlement.


6. Vouchers

Vouchers issued by NETT & NiEDLiCH GmbH:

  • are valid for an unlimited period
  • are non-transferable
  • cannot be redeemed for cash
  • can be redeemed online via the reservation system as well as on site

Vouchers may be used for reservations as well as for additional services at the café.


7. Cancellation and Refund

A cancellation of the reservation is possible at any time until the start of the reserved time slot.

In the event of a timely cancellation, the refund is made exclusively in the form of a voucher in the amount of 100 % of the paid amount.

The voucher is provided to the customer electronically and may be used for future reservations or visits.


8. No-Show (Failure to Appear)

If no one appears for the reservation by the start of the reserved time slot, the reservation is considered a No-Show.

In this case, any entitlement to a refund is fully forfeited.

A refund or gesture of goodwill is granted solely on a voluntary basis and without any legal entitlement.


9. Refund of Monetary Amounts

There is generally no entitlement to a refund of the paid amount in cash.

In individual cases and after individual review, a refund may be granted as a gesture of goodwill. There is no entitlement to such a refund.

If a refund is granted, it will be made exclusively to the original payment method used.


10. Duty of Supervision and Use of the Play Area

The duty of supervision for children lies at all times with the parents or legal guardians.

Use of the play area is at the user’s own risk. We accept no liability for damage caused by improper use.


11. Liability

We are liable without limitation in cases of intent and gross negligence.

In cases of simple negligence, we are liable only in the event of a breach of material contractual obligations (cardinal obligations) and limited to the foreseeable, contract-typical damage.

Liability for slight negligence is excluded to the extent permitted by law.


12. House Rules

The following house rules apply in our café:

  • Eating and drinking are not permitted in the play area.
  • Bringing your own food and drinks is not permitted.

We reserve the right to take appropriate measures in the event of violations.


13. Final Provisions

The law of the Federal Republic of Germany shall apply.

Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
